1. Introduction and Acceptance

Welcome to UseResume.ai ("UseResume," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of useresume.ai and all related services. By using our service, you acknowledge that you have read and agree to these Terms.

2. Definitions

  • "Service" means the UseResume.ai website and all related features
  • "Content" means any resumes, CVs, cover letters, or other materials you create using our Service
  • "AI Credits" means our system for measuring AI features usage
  • "Document Downloads" means the conversion of your content and downloading the documents in the final format
  • "API Platform" means the resume-generation API and related developer tooling offered separately from the main UseResume web application

3. Our Service

UseResume provides tools to create professional resumes and cover letters, enhance them with advanced AI technology, and transform them into beautifully designed documents. Our subscription plans are structured to make these tools accessible while covering the costs of our technology and maintaining high-quality service. Our service utilizes advanced AI Large Language Models (LLMs) from OpenAI and Anthropic to enhance your documents. Please note that AI optimization is an integral part of our service and cannot be disabled, as it forms the core functionality of our platform.

3.1 AI Enhancement Process

Our AI technology:

  • Analyzes job descriptions to identify key requirements
  • Enhances professional terminology and phrasing
  • Suggests improvements for clarity and impact
  • Generates tailored content based on your input
  • Personalizes documents for specific job applications

3.2 API Platform (Resume-Generation API)

  • The API Platform is a distinct product from the main UseResume application with separate pricing, credits, and terms.
  • The money-back guarantee described for the main application does not apply to API Platform usage or credits.
  • Credit Usage & Expiration: API usage is metered via credits. Credits allocated via monthly subscription plans reset at the start of each new billing cycle. Unused credits do not roll over to the next month.
  • Consumption: Successful calls consume credits as documented (standard document generation: 1 credit, tailored generation: 5 credits, document parsing: 4 credits). Validation errors do not consume credits.
  • Data Retention: API responses include time-limited signed URLs to generated documents; these URLs expire after 24 hours and should be downloaded promptly. Generated documents processed via the API Platform are retained for up to 14 days in our storage and then deleted.
  • We provide the API Platform on a commercially reasonable efforts basis; no specific SLA or uptime guarantee is provided, unless otherwise agreed upon in a separate contract. Planned maintenance or incidents may interrupt availability, and service credits (not refunds) may be offered at our discretion.

3.3 Storage and Retention

  • Generated documents (web app and API) are stored for up to 14 days, after which they are permanently deleted.
  • Download links provided in responses typically expire within 24 hours; download promptly to avoid loss.
  • We may retain minimal metadata (e.g., run IDs, billing/credit usage) for compliance and audit purposes beyond 14 days.

3.4 AI Processing Limitations

While our AI technology is advanced, please note that:

  • All AI-generated content should be reviewed for accuracy
  • You are responsible for the final content of your documents
  • AI suggestions are recommendations and may not always be perfect
  • Some industries or positions may require additional manual customization

4. Account Management

4.1 Account Creation

To create an account, you must:

  • Use a valid email address
  • Provide accurate and complete account information
  • Maintain the security of your account credentials

4.2 User Responsibilities

You agree to:

  • Use the Service in compliance with applicable laws
  • Maintain the confidentiality of your login credentials
  • Ensure you have necessary rights to any information included in your documents
  • Not attempt to exploit or compromise the Service

5. Subscription and Payments

5.1 Subscription Terms

  • All payments are processed securely through Stripe Payments Europe, Limited
  • Subscriptions include AI credits that reset with each billing cycle (unused credits do not roll over)
  • Additional AI credits are available for purchase
  • Subscription features and limits are defined by your chosen plan
  • Subscriptions automatically renew unless cancelled
  • Access continues until the end of the current billing period after cancellation; at the end of the period, any remaining credits associated with the subscription will expire

5.2 Pricing and Changes

  • We reserve the right to modify subscription prices at any time
  • Price changes will be announced at least 30 days in advance
  • New prices apply at your next billing cycle
  • Current subscribers will be notified via email of any price changes
  • Special pricing or promotional offers may be introduced or discontinued at our discretion

5.3 Refund Policy

All plans start with a free trial and, therefore, refund requests are evaluated on a case-by-case basis and are not automatically guaranteed. Refund requests are honored at our discretion in cases of good-faith dissatisfaction.

  • Refunds and money-back guarantees do not apply to API Platform credits or usage.

5.4 API Platform Plan Changes and Upgrades

  • Upgrades: Upgrades to higher-tier plans (including API Platform plans) are billed immediately. You will be charged a pro-rated amount for the remainder of the billing period.
  • Credit Allocation on Upgrade: Upon upgrading, additional credits are granted proportionally based on the amount paid. These credits are added to your current existing balance immediately.
  • Downgrades: Downgrades take effect at the next renewal date; no retroactive refunds or credits are provided for the current period.

6. Content and Data Rights

6.1 Content Ownership

  • You retain all rights to the content you create
  • You grant us a limited license to store and process your content for service delivery
  • We do not claim ownership of your documents or personal information

6.2 Data Protection

We are committed to protecting your data by:

  • Processing data in accordance with GDPR and our Privacy Policy
  • Implementing appropriate security measures for personal data
  • Providing options to export or delete your data
  • Implementing privacy by design principles in our AI processing systems

7. Service Availability

  • We strive to maintain consistent service availability
  • Occasional maintenance or updates may affect access
  • Service modifications may be implemented with reasonable notice

8. Intellectual Property

  • The Service and its original content, features, and functionality are owned by UseResume
  • You may not copy, modify, or reverse engineer any aspect of the Service
  • All trademarks, service marks, and trade names are our property

9. Limitation of Liability

To the extent permitted by law:

  • While we work hard to provide reliable and effective services, UseResume is provided "as is." We're continuously improving but can't guarantee specific outcomes from using our platform.
  • We are not liable for indirect, consequential, or incidental damages

10. Account Termination

10.1 Termination by User

  • You may cancel your subscription at any time
  • Access and credit usage continues until the end of the current billing period
  • Account deletion requests can be sent to app@useresume.ai

10.2 Termination by UseResume

We reserve the right to suspend or terminate accounts for:

  • Terms of Use violations
  • Fraudulent activity
  • Payment disputes
  • Extended inactivity

11. Data Processing

11.1 Data Processing Roles

In providing our Service, we act as:

  • Data controller for account information
  • Data processor for document content
  • We follow GDPR requirements for both roles

11.2 Data Subject Rights

You have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Request data deletion, including generated documents
  • Export your data
  • Object to certain processing
  • Request human intervention in automated decision-making processes
  • Receive meaningful information about the logic involved in AI processing

11.3 Automated Decision-Making

Our AI systems:

  • Use algorithms to enhance resume content
  • Make decisions based on parameters designed to optimize professional presentation
  • Do not make legal or similarly significant decisions about individuals
  • Allow for human review and adjustment of all AI-generated content
  • Process data according to the principles of data minimization and purpose limitation

12. Dispute Resolution

  • We seek to resolve disputes amicably
  • These Terms are governed by Estonian law
  • Disputes shall be resolved in Estonian courts

13. Modifications to Terms

13.1 Changes to Terms

  • We reserve the right to modify these Terms at any time
  • Changes become effective immediately upon posting to our website
  • Your continued use of the Service constitutes acceptance of modified Terms
  • Significant changes will be announced via email
  • You are responsible for reviewing Terms periodically

13.2 Effect of Changes

  • If you disagree with any changes, you may discontinue using the Service
  • Continued use after changes indicates acceptance of new Terms
  • Some changes may require explicit acceptance to continue using the Service
